1.1This procedure details the process of handling appeals received against decisions of accreditation committees of ANSI Accreditation Services.
2.1CAB: body that performs conformity assessment services (ISO/IEC 17000), further defined in ANSI AS Policy Manual (ANSI-PL-100).
2.2ACCREDITATION COMMITTEE: the appropriate accreditation committee based on the accreditation program involved in the appeal. Examples include ACC, PCAC, ACAC, CAPAC and GVAC.
2.3APPEAL: a request by a CAB for reconsideration of any action or inaction by an accreditation body directly related to its accreditation status. Such decision could be a:
a)refusal to accept an application;
b)refusal to proceed with an assessment;
c)corrective action request;
d)changes in accreditation scope;
e)decisions to deny, suspend or withdraw accreditation;
f)any other action that impedes the attainment of accreditation.
2.4APPELANT: A CAB registering an appeal.
2.5APPEALS TASK GROUP (ATG): A group of not less than three (3) volunteers appointed by an accreditation committee.
3How to Submit an Appeal
3.1Appeals must be received by ANSI within 30 days of notification to the CAB of the adverse decision by an ANSI accreditation committee. The appeal shall:
a)specify the grounds on which the appeal is made;
b)be accompanied by relevant documented evidence;
c)indicate what steps were taken to resolve the issue prior to lodging the appeal.
3.2While appellants are encouraged to submit appeals through ANSICA, appeals are also accepted by email, fax and registered mail or equivalent. Within five (5) days of ANSI’s receipt of an appeal ANSI shall send confirmation to the appellant of its receipt of such appeal.
3.3All appeals must be accompanied by an appeal fee to offset the costs and staff time associated with processing of the appeal.
4Levels of ANSI Appeals
4.1There are three levels of appeals available to CABs wishing to file an appeal. The appeals process shall follow the levels in sequence as listed below.
a)level 1 appeals are heard by an accreditation committee Appeals Task Group (ATG) of not less than three members;
b)level 2 appeals are heard by the full accreditation committee;
c)level 3 appeals are heard by the ANSI Appeals Board.
4.2The burden of proof to show adverse effect shall be on the Appellant.
4.3Appeals are processed by means of the ANSICA electronic platform. All appeals are logged in ANSICA. Records of appeal are maintained either in the Appeals Log or an appropriate notation is made in the Log while records are kept with the process of the CAB that filed the appeal. Using this system, ANSI maintains records related to the appeal, including evidence of communication, final decision and any follow-up actions taken. Specific technical instructions for managing appeals in ANSICA are available in the ANSICA Staff Manual. ANSICA’s client portal includes access to appeals lodged by that client and allows the authorized representatives of the CAB to file new appeals directly through this electronic system.
4.4ANSI’s website contains summary information on appeals including the type, status and a public summary, if available from the appellant.
5Review by ATG (Level 1)
5.1The ATG shall be screened for any potential conflict of interest in accordance with an accreditation committee’s Operating Procedures.
5.2ATG members shall review the appeal and may:
a)rule in favor of the appellant, promptly notifying the appellant and taking the appropriate actions;
b)rule against the appellant, notifying the appellant of this decision and informing such appellant of its right to appeal to Level 2;
c)request additional information from the appellant or involved parties;
d)involve assessors or other experts, screening them for conflict of interest in coordination with the appellant;
e)take any other action that is necessary or appropriate.
6Review by Full Accreditation Committee (Level 2)
6.1The accreditation committee of the relevant ANSI accreditation program shall be screened for any potential conflict of interest in accordance with that accreditation committee’s Operating Procedures.
6.2The accreditation committee shall conduct a hearing of the appeal in the following format:
b)presentations by appellant and any other materially interested party, limited to 30 minutes;
c)rebuttals from each party, limited to 10 minutes each;
d)additional discussion;
e)closed session discussion limited to the members of accreditation committee;
6.3The accreditation committee shall make decision by majority vote of its members, and provide prompt written notification to ANSI staff who will in turn convey this decision to the Appellant.
6.4As a result of the hearing, accreditation committee may decide to:
a)rule in favor of the appellant;
b)rule against the appellant;
c)request additional information from the appellant or involved parties;
d)involve assessors or other experts, screening them for conflict of interest and obtaining permission from the appellant to do so;
e)schedule another hearing.
6.5Provided that accreditation committee possesses all the necessary information to make an informed decision on the appeal, such committee shall take no longer than 90 days to conduct its work and reach a final decision.
6.6ANSI staff shall promptly notify the appellant of the accreditation committee’s decision, and in case of the negative decision, inform the appellant of further options to pursue.
7Review by the ANSI Appeals Board (Level 3)
7.1Review at this level shall be conducted in accordance with the ANSI Appeals Board Operating Procedures. This is the ultimate appeal with ANSI.
